I Preliminary Provisions

  1. These Terms and Conditions define the rules for the provision of services by the Seller to Internet users, including entrepreneurs, enabling them to book transportation and hourly yacht charters, along with the service of skipper assistance, via the rezerwacje.cruisemybay.pl platform, as well as the terms of use of the rezerwacje.cruisemybay.pl website.
  2. Access to the functionalities of the rezerwacje.cruisemybay.pl website requires the use of a device capable of connecting to the Internet and equipped with a standard web browser.

II Definitions

  1. The terms used in these Terms and Conditions shall have the following meanings:
    1. Seller – Adam Reński, conducting business activity under the name Adam Reński CruiseMyBay, with a permanent place of business and a mailing address at ul. Gen. Sikorskiego 4/4, 81-827 Sopot, NIP: 9570687547, REGON: 528892432, contact details: email address: info@cruisemybay.pl, telephone number: +48 535 939 273.
    2. rezerwacje.cruisemybay.pl Website – an online service operated by the Seller in Polish, English, and German, enabling Internet users to book transportation between designated marinas or hourly yacht charters, including skipper assistance. The service is available at the domain rezerwacje.cruisemybay.pl.
    3. Yacht – the SAXDOR 320 GTC yacht.
    4. User – a natural person with full legal capacity, a legal entity, or an organizational unit without legal personality but capable of acquiring rights and incurring obligations in its own name, who, by completing the booking form on rezerwacje.cruisemybay.pl, gains access to the services provided under these Terms and Conditions.
    5. Client – a User taking actions to purchase or purchasing services under an Agreement concluded through the Reservation System.
    6. Reservation System – a system managed and operated by the Seller, available at the domain rezerwacje.cruisemybay.pl, used for managing yacht reservations and rentals.
    7. Offer – a proposal to conclude a Service Sales Agreement under the conditions specified by the Seller, including the price and type of service offered, using the Reservation System.
    8. Yacht Charter – the service that is the subject of the Offer.
    9. Agreement – a charter agreement in which the Seller undertakes, for a fee and within a specified period, to rent the Yacht to the Client, along with skipper assistance, under the terms specified in the Terms and Conditions of the rezerwacje.cruisemybay.pl Website.
    10. Payment Operator – the Tpay payment system operated by the company Krajowy Integrator Płatności S.A., headquartered at plac Andersa 3, 17th floor, 61-894 Poznań, registered in the Register of Entrepreneurs maintained by the District Court Poznań – Nowe Miasto and Wilda in Poznań, VIII Commercial Division of the National Court Register under KRS number 0000412357, NIP: 7773061579, REGON: 300878437, with fully paid-up share capital of PLN 5,494,980.00.
    11. Transactions – procedures for concluding and executing service sales agreements between the Seller and the Client.
    12. Terms and Conditions – this document.

III. Rules for Using the Reservation System

  1. The Seller provides Users with access to the Reservation System on the rezerwacje.cruisemybay.pl Website, enabling online Yacht Charter, available 24/7. The Reservation System allows the User to select a travel option, choose the starting marina, destination marina, and date.
  2. Yacht Charter Reservation Procedure:
    1. The User selects one of the travel options, including “one-way transport,” “round-trip transport,” or “time-based cruise.”
    2. The User selects the starting marina by expanding the panel with the list of available starting marinas.
    3. The User selects the reservation date by expanding the calendar panel.
    4. The User selects the destination marina by expanding the panel with the list of available destination marinas.
    5. If choosing the “round-trip transport” option, the User selects the return trip date by expanding the calendar panel.
    6. If choosing the “time-based cruise” option, the User selects the cruise duration by expanding the list of available time slots.
    7. The User provides the number of passengers on the Yacht (number of persons over the age of 10 and number of children aged 0 to 9), as well as the number of bicycles and/or oversized luggage.
    8. The User clicks the “Reserve” button.
    9. On the next page, the User receives a full-day list of Offers for the selected transport. On this page, the User may modify the search parameters in the same manner as described in points 1) to 7) and then click the “Search” button.
    10. The User selects an Offer, accepts the Yacht Charter price, and clicks the “Next” button.
    11. On the next page, the User fills in their details: “First Name,” “Last Name,” “Email,” and “Phone Number.” Additionally, the User informs the Seller whether they wish to receive an invoice, enters any special requests for the order, and specifies how they found out about the rezerwacje.cruisemybay.pl Website. On this page, the User must also accept the Terms and Conditions of the rezerwacje.cruisemybay.pl Website, the Yacht Regulations, and consent to the provision of services via electronic means. Acceptance of these regulations and consent to electronic service provision is required to conclude the Agreement and complete the Transaction through the Payment Operator. Optionally, the User may consent to receive newsletters and promotional materials from the Seller via email. The User can return to the previous page by clicking the “Back” button or proceed to the next step by clicking the “Next” button.
    12. On the next page, a summary of the service conditions included in the Offer is displayed. The User can also enter a personalized discount code in the “Discount” field and click the “Apply” button. The User can return to the previous page by clicking the “Back” button or proceed to the payment step by clicking the “Pay” button, after which the reservation is created in the system, and the User is redirected to the Payment Operator’s website.
    13. Payment of the price via one of the payment options provided by the Payment Operator to the Seller constitutes the conclusion of the Agreement. The User has 30 minutes to complete the payment. If the User fails to make the payment within this time, the reservation is removed from the system.
    14. Upon completion of the Transaction, the Client receives a confirmation email from the Payment Operator and a confirmation of the Agreement from the Seller. The confirmation email includes a ticket with a QR code (two separate QR-coded tickets if booking a round-trip), which serves as proof of the Agreement, as well as the Yacht Regulations in PDF format. The Client must present the received QR-coded ticket, either electronically or in printed form, to the Yacht skipper before boarding. The email also contains a link allowing the Client to cancel their reservation.
    15. If the Client has requested an invoice, it will be issued and sent to the Client’s email address after the Transaction is completed (two separate invoices for round-trip bookings). By accepting the Terms and Conditions, the User consents to receiving invoices electronically.
  3. The Client is entitled to cancel a reservation free of charge up to 120 hours before the start time of the Yacht Charter by clicking the link received via email. The Client will receive an email and SMS reminder 24 hours before the deadline for free cancellation.
  4. In the event of a cancellation, the Seller will refund the full price paid by the Client via bank transfer or credit card, depending on the payment method used during the Transaction, within 5 business days of the cancellation. If an invoice has been issued, a correction invoice will be sent to the Client’s email address provided during the reservation process.
  5. If the Yacht reservation is canceled within 120 hours of the selected Yacht Charter start time, the Seller is not obligated to refund the Client’s payment.
  6. 24 hours before the Yacht Charter, an email and SMS reminder will be sent to the Client’s email address and phone number provided during the reservation.
  7. The Seller has the right to cancel a reservation and withdraw from the Agreement with the Client due to a forecast of adverse weather conditions during the selected Yacht Charter period that may pose a safety risk to passengers, crew, or the Yacht. The Seller also has the right to cancel a reservation due to unforeseen events beyond its control, including but not limited to Yacht malfunctions. The Seller will notify the Client via email and SMS before the scheduled service time in the event of a cancellation and withdrawal from the Agreement. If the reservation is canceled for any of the aforementioned reasons, the Seller will, if possible, offer the Client an alternative Yacht Charter date.
  8. For any questions or technical issues regarding the rezerwacje.cruisemybay.pl System, Users may contact the Seller via email at info@cruisemybay.pl or by phone at +48 535 939 273 (available from 9:00 AM to 6:00 PM).

IV. Complaints

  1. Complaints regarding services provided by the Seller should be submitted electronically via email to info@cruisemybay.pl or by registered mail to the Seller’s address within 7 days of the occurrence of the cause for the complaint.
  2. The complaint should include the User’s details (first name, last name, mailing address, email address, phone number, and reservation number), as well as the circumstances justifying the complaint (its reasons) and a detailed description of the claim.
  3. The Seller will respond to the User’s complaint within 14 days of receiving the complaint submission containing all necessary information to process the complaint.
  4. If the information provided in the complaint needs supplementation, the Seller will request additional details from the User within a specified timeframe.
  5. If it is not possible to resolve the complaint within the above-mentioned period, the Seller will inform the User and indicate the expected resolution timeframe.
  6. The User will be notified of the complaint resolution via email sent to the address provided in the complaint or to the mailing address held by the Seller.
  7. Complaints that do not allow for User identification will not be processed.

V. Liability Rules

  1. The Seller is not responsible for:
    a) The operation of telecommunication systems or devices independent of the Seller,
    b) Failures and errors in the functioning of the Payment Operator’s website,
    c) Force majeure events.
  2. The liability exclusions specified in section 1 apply, among others, to the loss of data stored in the rezerwacje.cruisemybay.pl system due to random and unforeseeable failures or other accidental events beyond the Seller’s control, as well as the suspension of the Service due to events such as a power outage affecting the servers.
  3. All content of the rezerwacje.cruisemybay.pl website—text, graphics, software, and other materials, as well as the layout and compilation of this content—is protected by copyright. The rezerwacje.cruisemybay.pl website contains materials protected by intellectual property laws. Any use, including distribution, publication, reproduction, public display, or any other form of exploitation of the content on the rezerwacje.cruisemybay.pl website without the Seller’s consent is prohibited.

VI. Privacy and Confidentiality

The Seller collects and processes Users’ personal data in accordance with applicable laws and the Privacy Policy, which is attached as Annex No. 1 to these Terms and Conditions.

VII. Withdrawal from the Agreement

Notwithstanding the Client’s right to cancel the reservation 48 hours before the start of the Yacht Charter, a Client who is a consumer or a sole proprietor entering into an Agreement directly related to their business activity, where the Agreement is not of a professional nature as determined by the scope of their business activity registered in the Central Register and Information on Economic Activity, may, in accordance with the Consumer Rights Act of May 30, 2014, withdraw from the Agreement without stating a reason within 14 days of its conclusion.

The rules for withdrawal from the Agreement, including a sample withdrawal form that the Client may use, are outlined in the withdrawal instructions attached as Annex No. 2 to these Terms and Conditions.

Withdrawal in this manner is not possible if the Seller has already commenced providing the Yacht Charter service. The commencement of the Yacht Charter service is understood primarily as the beginning of the Yacht’s journey to the starting marina selected by the Client during the reservation process.

VIII. Amendments to the Terms and Conditions

  1. The Seller may amend the Terms and Conditions. The Seller will inform Users about any changes and their effective dates via the rezerwacje.cruisemybay.pl website and by electronic means.
  2. Amendments to the Terms and Conditions will take effect no earlier than 7 days from the date of their publication on the rezerwacje.cruisemybay.pl website and notification to Users via electronic means.

IX. Final Provisions

  1. The governing law for the Agreement between the Client and the Seller is Polish law.
  2. Any disputes related to the services provided via the rezerwacje.cruisemybay.pl website will be resolved by the competent common court for the Seller.
  3. If any provision of these Terms and Conditions is deemed invalid by a final court ruling, the remaining provisions shall remain in effect.
