This Regulation, hereinafter referred to as the “Regulation,” defines the terms of use of the SAXDOR 320 GTC yacht, hereinafter referred to as the “Yacht,” by individuals using the yacht charter, hereinafter referred to as the “Users.”
- Each User of the Yacht is obliged to comply with the Regulation and follow the recommendations, instructions, and orders of the Yacht’s skipper and crew.
- The Yacht may be used in the Gdańsk Bay and open sea at a maximum wind speed of up to 26 knots (equivalent to 6 on the Beaufort scale) at the time of departure from the initial marina. If the wind strength exceeds this limit or forecasts predict worsening weather conditions, the skipper has the right to cancel or terminate the cruise.
- The Yacht may only be operated with the participation of the Yacht’s skipper, whose service and presence on the cruise are provided by the Yacht’s owner.
- The User and the skipper acknowledge that using the Yacht involves risks of accidents, injuries, or other physical harm, as well as the risk of property damage. In extreme cases, using the Yacht on the water may lead to capsizing, posing a direct risk of drowning, hypothermia, or bodily harm.
- Appropriate footwear with soft soles is required on the Yacht. Individuals wearing inappropriate footwear may be asked to remove their shoes and remain barefoot. The Yacht’s owner recommends carrying a change of clothing and storing personal belongings in waterproof containers.
- The Yacht’s owner and the skipper are not responsible for electronic equipment, valuables, or other personal belongings left at the marina or brought onboard.
- The Yacht’s owner provides life jackets for Users and the skipper. The owner recommends that all Users and the skipper wear life jackets. Users who choose not to wear life jackets do so at their own risk. However, individuals who cannot swim and minors, especially children, are required to wear a life jacket. The Yacht’s owner and the skipper are not responsible for verifying the Users’ swimming skills. The owner does not provide insurance for Users during the yacht charter and recommends storing emergency contact numbers for WOPR (Water Rescue Service) and the Police (WOPR – 984, Emergency number – 112) in their mobile phones.
- Minors cannot use the Yacht without adult supervision. Parents or guardians are responsible for minors using the Yacht.
- The maximum number of people allowed onboard during a cruise is nine, including crew members. If Users attempt to board with more individuals than declared during the reservation process on rezerwacje.cruisemybay.pl, the skipper has the right to refuse boarding without a refund or the option to reschedule the booking.
- The Yacht is designed to transport a maximum of two bicycles and/or pieces of large luggage (total dimensions exceeding 200 cm in length + width + height), which must be accompanied by at least one adult. The skipper is responsible for securing and arranging these items on board. If Users attempt to board with more items than declared during the reservation, the skipper has the right to refuse boarding without a refund or rescheduling options.
- The Yacht is equipped with a toilet. Users must use it according to the instructions. It is strictly forbidden to dispose of any objects, toilet paper, or hygiene products in the toilet; these should be placed in the designated bin.
- The consumption of alcohol and intoxicating substances is strictly prohibited on the Yacht during the cruise. This applies to both the skipper and Users. If the skipper suspects that a User is under the influence of alcohol or drugs, posing a safety risk to others, the skipper, or the Yacht, the cruise may be terminated immediately without a refund or rescheduling options.
- Smoking and the use of open flames are strictly prohibited on the Yacht.
- Users agree to use the equipment entrusted to them on the Yacht properly and return it in the same condition.
- Users are responsible for any damage or loss of the Yacht’s equipment (e.g., life jackets) caused by their actions.
- The Yacht’s equipment includes:
- 9 life jackets
- 1 lifebuoy
- 25-meter rescue rope
- 1 first aid kit
- 2 fire extinguishers
- 1 fire blanket
- Users must maintain cleanliness on the Yacht and avoid littering.
- Users are strictly prohibited from throwing any objects or belongings overboard.
- Users must not leave the Yacht to swim in the sea during the cruise without the crew’s permission.
- The transportation of animals on the Yacht is prohibited. The skipper has the right to deny boarding to any User accompanied by an animal. In such cases, no refund or rescheduling will be granted.
- The Yacht is insured for third-party liability (OC), accident insurance (NNW), and yacht hull insurance (JACHT-CASCO). In case of a malfunction or other damage that prevents the continuation of the cruise or threatens the safety of Users, the skipper, or the Yacht, the skipper must immediately notify the Yacht’s owner, terminate the cruise, and return to the marina.
- The owner declares that the Yacht is in full working order when provided to Users. However, in cases of force majeure, malfunctions occurring during the cruise that render the Yacht inoperable, unfavorable weather conditions that hinder or prevent the cruise, or other unforeseen events beyond the owner’s and skipper’s control, the owner will, if possible, offer an alternative charter date to Users.
- Boarding the Yacht signifies the User’s acceptance of this Regulation.
- A User making a reservation through rezerwacje.cruisemybay.pl accepts this Regulation and receives a copy at the email address provided during the reservation process.
- A copy of this Regulation is available to all Users onboard the Yacht.
- The User confirms that they have read and accept the provisions of this Regulation
